In recent years there have been substantial changes in California criminal law related to the reduction of convictions and early release from prison, as well as for possession of marijuana. This does not mean in any way that a person accused of committing a felony or misdemeanor can evade the penalty or get out of jail easily.

The complexity of the new laws requires study, capacity and experience by the lawyer to know when and how to use the law for the benefit of the client. Not all those prosecuted for crimes qualify to receive a penalty reduction if the lawyer does not present a successful case and acts with skill in court.

Lluis Law criminal defense lawyers know when to make a request to the court to obtain an early release or for the inmate to receive a reduction in prior conviction for minor or serious crimes. Our lawyers look for each client to obtain the greatest possible benefits and clean their criminal record, so that they can obtain better jobs and lead a better life.

How to avoid a serious criminal conviction?

We know from our experience of more than 40 years serving in the Los Angeles area as criminal defense lawyers, that a convicted person not only pays a prison sentence and in many cases pecuniary sentences, but also must carry the stigma for life social supposed to be a former convict.

Although the laws prohibit discrimination for this reason, in practice many doors are closed when this type of stain remains on a person's resume. Obtaining a good job is difficult or prevents obtaining a professional license (for example, CPA, MD, JD), because the person is considered dangerous or unworthy.

The law allows the removal of criminal records under Section 1203.4 of the California Penal Code. The defendant and convicted of a crime has the right to withdraw their guilty plea (nolo contendere), then submit a non-guilty plea and have the court dismiss the charges in the criminal case.

However, even if the lawyer succeeds in successfully completing this process, the defendant will have to inform the licensing board about a previous criminal conviction or when applying for a job in the government. The best thing for the defendant before being convicted of a serious crime of wobbler, is that their lawyer manages to make the crime charged be reduced to a misdemeanor.

In Lluis Law we have achieved in dozens of cases of robbery, forgery, assault, domestic violence, and DUI, among others, that serious crimes be reduced to minor crimes before conviction in a criminal court. Some of the reasons we have alleged to request and justify the reduction in these types of requests are related to:

  • Lack of prior registration;
  • Preventive rehabilitation programs;
  • Future perspectives at work or school;
  • Summon the character and reputation of the accused in the community.
  • Family dynamics.
